Privacy Policy

1. Definitions

  • “Act” refers to the applicable legislation governing privacy and consumer protection in the state where services are provided.
  • “Authorised Person” means the individual or contractor designated by Bathroom Surgeon to carry out services.
  • “Completion Date” means the date when Bathroom Surgeon completes the agreed-upon services.
  • “Contract” includes the quotation, service agreement, and these terms and conditions.
  • “Bathroom Surgeon” refers to Bathroom Surgeon Pty Ltd, including its subsidiaries, successors, and permitted assigns.
  • “Owner” means the person or entity engaging Bathroom Surgeon, including their agents, representatives, and successors.
  • “Parties” refers to Bathroom Surgeon and the Owner.
  • “Quotation” refers to the documented service quote provided to the Owner.
  • “Representative” means any individual acting on behalf of Bathroom Surgeon in connection with this agreement.
  • “Site” refers to the location where Bathroom Surgeon will conduct work.
  • “Work” refers to the services provided by Bathroom Surgeon under this agreement.

2. Quality of Work

2.1 All work performed by Bathroom Surgeon will comply with:

  • The Building Code of Australia as required under relevant state legislation.
  • Applicable standards and regulations as prescribed by Australian law.
  • Any required permits, approvals, or development consents.

2.2 Bathroom Surgeon is not responsible for design flaws, specifications, or instructions provided by the Owner that do not comply with Clause 2.1.

3. Scope of Work

3.1 The quotation and service agreement define the scope of work. Any variations must be documented and agreed upon in writing.

3.2 The Owner must inform Bathroom Surgeon of any pre-existing issues that may affect the completion of the work, including previous repairs or external reports.

3.3 Bathroom Surgeon only provides visual inspections. The Owner is responsible for engaging a plumber or obtaining a structural report if necessary.

3.4 Tile and grout preparation may involve chemical treatments, which can alter tile appearance. The Owner acknowledges this possibility, and any changes will not be considered defects.

3.5 The work area must remain dry for at least 24 hours before and after the completion of services.

4. Plumbing and Painting

4.1 The quoted price does not cover plumbing services. The Owner is responsible for hiring a plumber for any related issues.

4.2 Bathroom Surgeon does not provide painting or decorative services.

5. Latent Defects & Structural Movement

5.1 Bathroom Surgeon is not liable for pre-existing defects or structural deterioration that become evident after service commencement.

5.2 If additional work is required due to latent defects, an updated quotation will be provided.

5.3 Bathroom Surgeon is not responsible for damages caused by structural movement after work completion.

6. Payment Terms

6.1 The Owner must pay in full upon completion of work unless otherwise agreed in writing.

6.2 Work is deemed complete when all specified tasks are finished, and the area is cleaned.

6.3 If payments are delayed, a 10% per annum interest rate may apply on outstanding balances.

7. Project Timelines

7.1 Bathroom Surgeon will complete the work within a reasonable timeframe.

7.2 Delays beyond Bathroom Surgeon’s control, such as weather, supply shortages, or unforeseen site issues, may result in schedule adjustments.

8. Variations

8.1 Changes to the agreed scope of work must be documented and approved in writing.

8.2 Additional work may result in an adjusted quotation.

9. Warranty & Liability

9.1 Bathroom Surgeon warrants that all work will be performed professionally and using quality materials.

9.2 Warranties cover workmanship but do not extend to:

  • Pre-existing issues, structural movement, or Owner modifications.
  • Damage from accidents, misuse, or external factors.
  • Products not supplied by Bathroom Surgeon.

10. Access & Site Conditions

10.1 The Owner must provide necessary access for Bathroom Surgeon to complete the work.

10.2 If access is denied or the site is not prepared, additional charges may apply.

15. Consumer Rights

15.1 This agreement does not override Australian Consumer Law protections.
